*** WELLS FARGO FORECLOSURE SALE OVERTURNED *** 

This borrower had been in negotiations for over a year for a loan modification the bank lead him to believe that he was going to get a modification. Wells Fargo employees had also told him they had stopped the foreclosure process.

If you can imagine this - They Lied To Him - and on June 5th of 2009 they sold his home.

We were able to intercede and work hand in hand with legal counsel to prove that the lender acted in bad faith.

The sale was overturned due to the fact that Wells Fargo employees had not lived up to the "commitments" they had made by entering into loan modification efforts with the borrower.

The Judge in this case has indicated a desire to see Wells Fargo work in good faith towards keeping the borrower in their home with a loan modification.

*** WACHOVIA FORECLOSURE SALE DATE POSTPONED *** 

This file is a 2nd mortgage where Wachovia employees claimed to be working on qualifying the borrower for a loan modification. They asked for document after document and agreed that once they had received they requested documents they would postpone the foreclosure sale date.

The day after they had all of the documents they requested we were told that Wachovia employees were no longer allowed to discuss loans with authorized 3rd parties and that this was a "new government guideline". After questioning these employees we were given the name of the person who supposedly issued the "new directive". She indicated that she had never issued any such directive.

We worked along with legal counsel to prove that Wachovia had acted in bad faith.
 
A Judge issued a Temporay Restraining Order that postponed the Foreclosure Sale Date and has also Ordered that the lender participate in a mandatory settlement conference.

*** BANK OF AMERICA FORECLOSURE CASE DISMISSED *** 

After more than a year of torture at the hands of Bank of America this borrower acheived a loan modification. The property had been on the foreclosure sale calendar numerous times. Those sale dates were all postponed and eventually the case was dismissed.

The Judge signed the order to dismiss on March 25th, 2010 and now the borrower can go on with their life.
